Terms of Service

These Terms of Service replace all prior versions. For existing users who have already interacted with our Services before March 21, 2026, the previous Terms remain in effect until March 30, 2026. By continuing to use our Services after March 30, 2026, existing users agree to be bound by these updated Terms. If you do not agree with the updated Terms, you may stop using our Services before the effective date.

New users accessing the Services on or after March 21, 2026, are bound immediately by these Terms.

Please read these Terms of Service (“Terms”) carefully before using the ujayden.com website and all associated services operated by uJayden (collectively, the “Service” or “Services”).

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

1. ACCEPTANCE OF TERMS

The Services covered by these Terms include, but are not limited to:

  • uSpace (Blog, this site)
  • File Sharing, Collaborate, Messaging, Forms Service (cloud.ujayden.com)
  • uJayden’s Profile Showcase Website (hub.ujayden.com)
  • Generative AI Chat Service (chat.ujayden.com)
  • CDN (cdn.ujayden.com)
  • API service (api.ujayden.com)
  • Discord bots operated by uJayden
  • And other connected web/online services

By using the Services, you affirm that you are of legal age to enter into this agreement (or have obtained parental or guardian consent) and that you accept and agree to be bound by these Terms.

2. ELIGIBILITY

By using the Services, you represent that you:

  • Are at least 13 years old, or meet the minimum age of digital consent in your jurisdiction.
  • Are not a resident of the European Economic Area (EEA) or United Kingdom (UK), as the Services are not directed or marketed to those regions.
  • Have the legal capacity to agree to these Terms.

3. PRIVACY POLICY AND THIRD-PARTY SERVICES

Your access to and use of the Services is also conditioned on your acceptance of and compliance with the uJayden Privacy Policy. The Privacy Policy describes our policies and procedures on the collection, use, and disclosure of your personal information when you use the Services and tells you about your privacy rights and how the law protects you.

The Service utilizes various third-party tools and embedded content (including but not limited to Gravatar, Google Analytics, reCAPTCHA, Cloudflare, Microsoft Azure AI, Google Gemini API, Perplexity, and YouTube). Your use of these integrated features is subject to the respective third parties’ terms of service and privacy policies. uJayden is not responsible for the content, privacy policies, or practices of any third-party websites or services.

4. USE OF SERVICE AND USER CONDUCT

The Services are operated by uJayden, who manages these projects for personal and community purposes. These Services are not commercial operations and are provided “as is” for general informational and experimental use.

4.1 User Accounts and Registration

If you create an account on the Service, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer or device. You agree to accept responsibility for all activities that occur under your account or password.

  1. You must provide accurate, complete, and current registration information.
  2. You may not use as a username the name of another person or entity or a name that is otherwise offensive, vulgar, or obscene.
  3. uJayden reserves the right to refuse service, terminate accounts, remove or edit content.

4.2 Prohibited Conduct

You agree not to use the Service for any unlawful purpose or in any way that interrupts, damages, or impairs the Service. Prohibited conduct includes, but is not limited to:

  1. Posting or transmitting any Content that is harassing, defamatory, obscene, pornographic, or invasive of another’s privacy.
  2. Engaging in spamming, hacking, or distributing viruses or other harmful computer code.
  3. Impersonating any person or entity or falsely stating or otherwise misrepresenting your affiliation with a person or entity.
  4. Attempting to gain unauthorized access to any portion or feature of the Service, or any other systems or networks connected to the Service.
  5. Using the Service to promote or conduct illegal activities.

4.3 Discord Bot Usage

If you utilize the Discord bots operated by uJayden, you agree to the following specific terms:

  1. Discord Rules: Your use of the bots is subject to the Discord Terms of Service and Community Guidelines.
  2. Data Processing: You acknowledge that certain data (Discord User IDs, Server IDs, and message content) is collected and processed for the bot’s operation, as detailed in the Privacy Policy.
  3. Gemini API: You consent that message content and associated identifiers may be transmitted to the Google Gemini API for processing, subject to Google’s policies.
  4. Misuse: You must not engage in activities that overload, disrupt, or damage the bot’s functionality, including but not limited to excessive command usage (rate limiting abuse) or exploiting vulnerabilities.

Misuse the bots may result in blacklisting, service suspension or termination.

4.4 Generative AI Chat and Cloud Services

If you utilize the Generative AI Chat Service or Cloud Collaboration platform, include but not limit to form filling as a guest, you agree to:

  • AI Prompts: Not input highly sensitive personal, financial, or confidential information into AI chat prompts, as this data is transmitted to external third-party API providers for processing.
  • Cloud Usage: Use the cloud file-sharing and collaboration platform responsibly. Any data you generate or upload is persistently stored on our servers indefinitely unless manually deleted by you or requested for removal.

Misuse of Services: You agree not to abuse the Generative AI Chat or Cloud Services. Prohibited misuse includes, but is not limited to:

  • AI Abuse: Attempting to bypass AI safety filters or system instructions, generating illegal, harmful, or abusive content, or using automated scripts (e.g., scraping or botting) to flood the AI API service.
  • Cloud Abuse: Uploading or distributing malware, illegal content, or unauthorized copyrighted materials through the cloud platform.
  • Resource Abuse: Deliberately overloading system resources (such as excessive bandwidth consumption or storage hoarding) that could degrade server stability or disrupt the experience for other users.

Misuse the services may result in blacklisting, service suspension or termination.

5. USER CONTENT

The Services allow you to post, link, store, share, and otherwise make available certain information, text, graphics, videos, or other material (“Content”). This includes, but is not limited to, comments left on the uSpace blog.

Content License Grant: By posting Content, you grant uJayden a perpetual, worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such Content in connection with the operation of the Service. This license is necessary for uJayden to retain comments and their metadata indefinitely, as described in the Privacy Policy.

Responsibility for Content: You are solely responsible for the Content that you post on or through the Service, including its legality, reliability, and appropriateness. You affirm that the Content is yours (you own it) or you have the right to use it and grant us the rights and license as provided in these Terms.

Administrator Rights: While files and messages on the cloud platform are private to your account and those you explicitly share them with, uJayden, as the system administrator, retains the right to review, restrict, or delete files or data to maintain server stability, prevent abuse, or comply with legal obligations.

6. INTELLECTUAL PROPERTY

The Service and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of uJayden and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States, Hong Kong, and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of uJayden.

7. TERMINATION

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms, where reasonably necessary to protect the Service, users, or compliance with law.

If you wish to terminate your account, you may simply discontinue using the Service or request account deletion via the contact email provided in the Privacy Policy.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

8. DISCLAIMER OF WARRANTIES

The Services are provided on an “AS IS” and “AS AVAILABLE” basis. uJayden operates the Service as a personal and experimental project for personal interest and community purposes.

uJayden makes no representations or warranties of any kind, express or implied, as to the operation of the Service or the information, content, or materials included therein. You expressly agree that your use of the Service is at your sole risk.

uJayden does not warrant that:

  1. The Service will function uninterrupted, secure, or available at any particular time or location.
  2. Any errors or defects will be corrected.
  3. The Service is free of viruses or other harmful components.
  4. The results of using the Service will meet your requirements.
  5. AI-generated outputs from our Generative AI Chat Service or Discord bots will be accurate, reliable, or free from errors.

9. LIMITATION OF LIABILITY

In no event shall uJayden, nor its owner, employees, partners, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  1. Your access to or use of or inability to access or use the Service.
  2. Any conduct or content of any third party on the Service.
  3. Any content obtained from the Service.
  4. Unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.

Data Security Acknowledgment: You acknowledge that data transmission over the Internet may not be fully secure. As stated in the Privacy Policy, while we take reasonable security measures, no system is completely secure.

Your sole remedy for dissatisfaction with the Services is to discontinue use.

10. INDEMNIFICATION

You agree to indemnify and hold harmless uJayden from any claims, damages, or liabilities arising out of your use of the Services, your content, or your violation of these Terms, to the extent permitted by law.

11. MODIFICATION OR DISCONTINUATION

uJayden reserves the right to modify, suspend, or discontinue any part of the Services at any time without prior notice. This includes but is not limited to changes in features, APIs, or availability.

12. GEOGRAPHICAL LIMITATION AND JURISDICTION

A. Non-Targeting of EEA/UK Residents:

The Service is not intended for, and is not offered to, individuals residing in the European Economic Area (EEA) or the United Kingdom (UK). The Services are not actively targeted or marketed to residents of the EEA or the UK.

By accessing or using our Services, you confirm that you are not a resident of the EEA or the UK, or if you are, you acknowledge and agree that:

  1. You are using the Service on your own initiative and not based on any solicitation or targeting by uJayden.
  2. You understand that uJayden does not operate under the specific legal framework, enhanced obligations, or full protections afforded solely by the General Data Protection Regulation (GDPR) or similar EEA/UK data protection laws.
  3. You consent to the transfer of your personal data to, and processing in, jurisdictions including Hong Kong, Japan (Osaka), and the United States (Los Angeles, CA), where data protection laws may differ from those in your jurisdiction.

B. Governing Law and Dispute Resolution:

These Terms shall be governed and construed in accordance with the laws of Hong Kong Special Administrative Region, without regard to its conflict of law provisions.

Any dispute arising from or relating to the subject matter of these Terms shall be subject to the exclusive jurisdiction of the courts located in Hong Kong.

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

13. CHANGES TO TERMS

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 7 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
